The first part of the book reconstructs core evaluation concepts, with a focus on the origins of our values and biases. Value is the central concept in this volume, yet it's a fuzzy concept. In Part I, Ernie clarifies the concept of value by addressing basic questions: What are values? Where do they come from? Why do we have them? Why is our conception so confused? How do we handle values in evaluations? In Part II, another central concept is added, that of biases. Prominent evaluation frameworks have focused on biases, including Campbell and Stanley's (1963) framework for validating causal inferences and Scriven's (1972) conception of objectivity, which is achieved by correcting for biases in general. In addition, research on thought processes has made progress by focusing on cognitive biases (Kahneman, 2011). Even so, through a case example, Ernie demonstrates that the concept of biases is under-appreciated and not well engaged in evaluation practice. The third important concept, featured in Part III, is practical wisdom, which is the knowledge that evaluators acquire through experience. Practical wisdom informs what we do, possibly as much as theory. Experienced evaluators often conduct evaluations in similar ways, regardless of their theory, because practical wisdom determines much of what they do. Ernie provides concrete examples of practical wisdom and how we employ it. Throughout the book, he draws on the empirical research on thinking processes, especially Kahneman's Thinking Fast and Slow (2011). This book will be of interest and relevance to all evaluation scholars and practitioners, as it thoughtfully engages core constructs of the field. The book can also well serve as a supplementary text in multiple evaluation courses, as it offers valuable conceptual and practical perspectives on our craft. (shrink)

In this paper, we summarize the various impacts of incarceration with the aim of providing an overview of the ways mass incarceration affects society. In doing so, we look inside the black box of the largest penal experiment in world history: the quintupling of the prison population in the United States between 1973 and 2006. The question is, "What have been the social consequences of our incarceration policy?"One objective is to provide insight into what might be called the prison policy (...) paradox, namely, that a 500% generation_long growth in imprisonment has had little impact on crime. Answers are provided by looking inside the black box of penal policy and by identifying the various ways incarceration leads to social outcomes that are associated with public safety. The paper considers the problem of "public safety," because safety is a broader concept than crime. Though a desire for public safety includes a desire for low rates of crime, public safety connotes a more profound interest we have to live in a society where we feel secure pursuing our personal goals and fulfilling our life desires Using public safety as our criteria enables us to consider the ways incarceration affects our quality_of_life, especially through the way incarceration affects the informal social relations that promote the kind of profound social control that is a foundation for a sense of feeling safe.Three types of effects are described. Positive effects are those that improve public safety, negative effects reduce public safety, and "ambivalent" effects have the capacity to be both positive and negative. Five levels of social impacts on public safety are assessed:o Effects on individuals that change the way people act;o Effects on intimate relationships such as those with families and other loved ones;o Effects on social relationships that are felt as community_level outcomes;o Effects on institutions such as labor markets and the political economy;o Effects on democracy or social justice.Thus, the purpose of this paper is to summarize what is known, empirically and experientially, about the positive and negative ways incarceration affects levels of social expression. In 1992, the United States Supreme Court, in Planned Parenthood of Southeastern Pennsylvania v. Casey, upheld the ruling in Roe v. Wade, namely that women have a right “to choose to have an abortion before viability and to obtain it without undue interference from the State.”1 However, since this ruling, some states have imposed regulations that greatly limit this right by restricting access. Texas is a recent example of this. Two proposed restrictions in House Bill 2, which will be (...) discussed in detail below, will force all but eight clinics that are located in metropolitan areas to shut down. The U.S. Supreme Court put the proposed restrictions on hold in October 2014, allowing several clinics to remain open while the restrictions are being appealed in the U.S. Court of Appeals for the Fifth Circuit. If the restrictions are passed, however, those clinics will be forced to shut down and, as a result, many women in Texas will be required to travel more than 100 miles in order to access a safe and legal abortion. Much of the focus of these restrictions has been on women and rightly so. However, I want to turn the attention to physicians. The requirements exacerbate unfair treatment of abortion providers compared with other physicians. Abortion providers face threats from the public—some of which turn into violent attacks—and they are often ostracized by their fellow medical practitioners. There are so few abortion providers to begin with and the proposed requirements limit these physicians’ opportunities to practice the branch of medicine of their choosing. Although the HB 2 requirements may not result in an unconstitutional undue burden on physicians, the challenges created by the bill limit physicians’ abilities to provide abortions. As a result of these limits, HB 2 creates an unconstitutional undue burden for women seeking abortions by creating barriers directed at abortion providers and clinic staff who are willing and able to provide abortions. The first of the two controversial HB 2 requirements is the admitting privileges requirement: “A physician performing or inducing an abortion must, on the date the abortion is performed or induced, have active admitting privileges at a hospital that is located not further than 30 miles from the location at which the abortion is performed or induced.”2 The second requirement is the ambulatory surgical center requirement: “The minimum standards for an abortion facility must be equivalent to the minimum standards adopted under [Texas Health & Safety Code] [...] for ambulatory surgical centres.”3 In order to meet these state-mandated obligations, some abortion clinics would have to spend more than $1 million in upgrades if they wish to remain open. The District Court decided that the ambulatory surgical center requirement places an unconstitutional undue burden on women, and that the two requirements together place an undue burden on women in Texas and especially in the Rio Grande Valley where the nearest clinic is a couple hundred miles away.4 Later, the U.S. Court of Appeals for the Fifth Circuit reversed the District Court’s decision and argued, “the admitting privileges requirement is constitutional on its face.”5 While the regulations are being appealed, the Supreme Court granted a stay of injunction, allowing about twelve abortion clinics to reopen until a final decision regarding the regulations is made. The District Court ruled that the purpose of the two regulations was to create a substantial obstacle for women seeking abortions in Texas. While the defendants argued that the regulations were designed to make abortions safer and reduce risk, the Court decided that this was not the case. An abortion, especially a first-term abortion, is a very safe procedure and is safer than many other routine surgical procedures. As stated in Planned Parenthood v. Casey, “Unnecessary health regulations that have the purpose or effect of presenting a substantial obstacle to a woman seeking an abortion impose an undue burden on the right.”6 The undue burden in this case is imposed, not through restricting women’s access directly, but by restricting physicians’ freedom to perform abortions. The admitting privileges requirement has reduced the number of physicians who can perform abortions and the ambulatory surgical center requirement has reduced the number of clinics where abortions can be performed. The American Medical Association states, “[t]he Principles of Medical Ethics of the AMA do not prohibit a physician from performing an abortion in accordance with good medical practice and under circumstances that do not violate the law.”7 This means that physicians are not required to perform abortions, except in emergency situations, but can as long as the procedure is done safely and does not violate the law. The new Texas regulations, however, are so restrictive that few abortion providers, limited to only four urban areas, can legally perform abortions. Physicians do not have an absolute right to perform abortions as opposed to women who have an absolute right to have access to an abortion. Physicians do face many challenges that other professionals face in terms of obtaining qualifications and finding work. Abortion providers, however, face challenges that most other physicians do not. The restrictions imposed by these regulations exacerbate unfair treatment toward abortion providers and place further obstacles in their path in terms of providing the service they want and are qualified to provide. Both abortion clinics and abortion providers are being treated differently from other medical clinics and physicians. For instance, “grandfathering of existing facilities and the granting of waivers from specific requirements is prohibited for abortion providers, although other types of ambulatory surgical facilities are frequently granted waivers or are grandfathered.”8 Many abortion clinics cannot afford the necessary upgrades. Furthermore, it is extremely expensive to open a brand new clinic that complies with the ambulatory surgical center requirements. Being grandfathered in would be the only option available to abortion clinics that cannot afford the upgrade. However, unfair treatment of abortion clinics and providers is preventing those clinics from being grandfathered into the new system. As a result, many abortion clinics may be forced to close. Admitting privileges are proving difficult or impossible for physicians both to obtain and, for those who have already been granted privileges, to keep. Dr. Sherwood Lynn, an obstetrician-gynecologist who has performed abortions for decades, describes the process of obtaining admitting privileges and the difficulties abortion providers face. After sending in an application a physician must wait for the hospital to send them the required materials, “but if the address of the practice on the application is of an abortion provider or clinic, [the hospital] won’t send [them] the package of materials required. [They] simply can’t apply.”9 Dr. Lynn and several other physicians have surmised that hospitals are only withholding privileges from qualified physicians who perform abortions and that other physicians do not face this discriminatory treatment. Hospitals have also revoked privileges granted to physicians after learning that the physicians perform abortions. For instance, in Texas two doctors, “received notices [...] informing them that their admitting privileges to the University General Hospital of Dallas have been revoked, with the hospital’s CEO claiming the hospital was unaware they were providing abortion care and that the hospital believed such care would damage its reputation.”10 What is curious about this revocation is that, “federal and state laws [...] forbid hospitals from discriminating against doctors who perform abortions,” and yet hospitals are clearly doing just that.11 Dr. Pamela Richter, another abortion provider in Texas, had her temporary admitting privileges revoked with no explanation and because of this, the clinic where she performed abortions, Reproductive Services, can no longer provide abortions at all.12 As the hospital gave no reason for the revocation, it not clear Dr. Richter’s privileges were revoked because she performs abortions. Dr. Richter, however, has performed over 17,000 abortions and her privileges were revoked soon after HB 2 was introduced.13 According to the Texas Hospital Association, giving admitting privileges to doctors who do not work for the hospital is expensive and time-consuming but this does not account for the fact that hospitals are revoking previously granted privileges from physicians whom they learn are providing abortion services.14 As mentioned previously, the District Court found that the admitting privileges requirement and the ambulatory surgical center requirement do not further ensure the health and safety of women undergoing an abortion. Several physicians have testified to this fact. Dr. Lynn stated in an interview: The admitting privileges requirements are [...] absolutely unnecessary. If you have a number of patients waiting for procedures, and something happens and a patient needs to be transferred to a hospital, you’re not going to leave everyone else and go to the hospital. That makes no sense. You’re going to refer that person to a gynecologist at the hospital. There is no safety issue involved here. If a patient shows up with an emergency, every hospital is required to admit that patient. They have to by law.15 It is rare that complications will arise from an abortion performed in a clinic. Dr. Richter, for example, has performed more than 17,000 abortions and not once had to send a patient to a hospital because of complications resulting from the procedure. According to Dr. Lynn even if abortion providers were granted privileges to hospitals, it is unlikely that they will exercise them. In essence, having admitting privileges at a hospital does nothing to further ensure the safety of an already safe procedure. The only result of the admitting privileges requirement is to limit certain physicians’ ability to perform legal abortions. Not only do the HB 2 requirements fail to further ensure the health and safety of women, the HB 2 requirements may actually create more health risks to women who cannot access the eight remaining clinics. The first risk is that the remaining clinics would have an influx of patients that they may not be able to handle, forcing women to wait longer for an appointment. As stated by the District Court, “[e]ven assuming every woman in Texas who wants an abortion [...] could travel to one of the four metropolitan areas where abortions will still be available, the cumulative results of HB 2 are that, at most, eight providers would have to handle the abortion demand of the entire state.”16 Furthermore, “[t]hat the State suggests that these seven or eight providers could meet the demand of the entire state stretches credulity.”17 Abortion is a time sensitive procedure. It is safest when performed early in a pregnancy. The increase in patients to these remaining clinics, assuming all women in Texas can access them, will increase wait times and may force women to have abortions later in pregnancy. In the worst-case scenario, a woman would not see an abortion provider at all before viability. Such instances may be rare, but they are possible. In such cases, women’s access to legal abortions becomes impossible and thereby violate the ruling in Roe. Clinics may be able to avoid the aforementioned problems if they hire more physicians. However, there are two barriers to hiring more physicians. First, as mentioned previously, admitting privileges to Texas hospitals are difficult, if not impossible, for abortion providers to obtain. Second, given the negative treatment of abortion providers by anti-abortion groups, many physicians are not willing to perform abortions. The harassment abortion providers face is unique to those physicians and many physicians will not perform abortions for that reason. In an article published in the Austin Chronicle, anti- abortion activist Abby Johnson, “discusses how her group investigated appraisal district records to find the new location of where an Austin abortion physician plans to work.”18 Johnson states, “These abortionists are feeling the pressure from the pro-life movement in Texas. I think they feel like they’re on the run. And that’s how we want to keep it.”19 If the HB 2 requirements are passed and there remain at most eight abortion providers in Texas, these activists will concentrate on those clinics and, “the dangerous impact of their intimidation tactics will be exacerbated.”20 Even if the number of physicians needed to meet the demand in Texas can obtain admitting privileges and work at one of the remaining clinics, they may choose not to do such work because they are putting themselves at risk. The harm abortion providers face from such anti-abortion groups is not unique to Texas. There are stories from all over the country and from other countries where abortion is legal of physicians receiving death threats. Dr. George Tiller, an abortion provider in Kansas, was killed outside his church and had received numerous death threats prior to this. The HB 2 requirements are making it so that abortion providers either cannot provide their services any longer or will face increased threats and increased danger to themselves. Physicians are allowed to conscientiously object to providing medical interventions in certain circumstances for moral and religious reasons. However, there are limits on this right. According to the American Congress of Obstetricians and Gynecologists, “[w]hen conscientious refusals conflict with moral obligations that are central to the ethical practice of medicine, ethical care requires that the physician provide care despite reservations or that there be resources in place to allow the patient to gain access to care in the presence of conscientious refusal.”21 I would argue fear for one’s safety in the face of immediate threats is perhaps a stronger ground on which to refuse to provide care than a personal belief that abortion is immoral or against one’s religion. ACOG also states, “[p]roviders with moral or religious objections should either practice in proximity to individuals who do not share their views or ensure that referral processes are in place so that patients have access to the service that the physician does not wish to provide.”22 This responsibility has been largely disputed by the medical community but in cases of rape, incest, and health risks to women, referrals must be made without exception. However, under the requirements of HB 2, working in proximity to an abortion provider may not be possible because they are so geographically limited. Referrals are supposed to be made within reason. Some areas of Texas, such as the Rio Grande Valley, are up to 200 miles away from the nearest clinic that would remain open if HB 2 is passed. Referrals may simply not be feasible given the geographical distances and the decreasing number of available physicians. As mentioned above, there are two risks to the health and safety of women as a result of HB 2. The second of these is that if a woman cannot access one of the remaining clinics, she may seek out a more convenient but illegal and unsafe abortion, which is far more likely to result in a dangerous complication. Dr. Lynn states, “[b]ecause of the restrictions lawmakers impose, women will seek abortions illegally, and we’re going to see a rise in septic abortions.”23 Some areas of Texas might effectively revert back to a pre-Roe era where abortions were performed in unsanitary conditions by unqualified people resulting in dangerous medical complications far more often than legal abortion procedures do now. Physicians like Dr. Lynn who want to prevent this from happening generally cannot do so without facing legal sanction. Physicians have a duty to provide safe medical care and if they cannot obtain admitting privileges, they cannot exercise this duty. ACOG released a statement expressing their objections to the new requirements. They state that HB 2 is, “plainly intended to restrict the reproductive rights of women in Texas through a series of requirements that improperly regulate medical practice and interfere with the patient-physician relationship.”24 Executive Vice-President of ACOG, Hal C. Lawrence III stated: The Texas bills set a dangerous precedent of a legislature telling doctors how to practice medicine and how to care for individual patients. ACOG opposes legislative interference, and strongly believes that decisions about medical care must be based on scientific evidence and made by licensed medical professionals, not the state or federal government.25 Abortion is one of only a few areas of medicine where the legislature imposes so many regulations restricting particular physicians’ ability to practice medicine. Not only are abortions providers being regulated by the state, they are also facing clear discrimination from others within the medical community. The state is closing down clinics that do not meet the ambulatory surgical center requirements and hospitals are denying physicians admitting privileges because they perform abortions. In summary, abortion providers are being discriminated against both by the legislature and other members of the medical community. Other physicians who do not perform abortions are not denied admitting privileges on discriminatory grounds. Clinics that cannot afford upgrades to become an ambulatory surgical center are being grandfathered in, while abortion clinics are being forced to close down. Ob-Gyns who conscientiously object to performing abortions and who are not located in close proximity to at least one abortion provider cannot effectively fulfill their duty to refer patients. Lastly, given the barriers these regulations will create, there will likely be a rise in complications resulting from abortions provided under grossly unsafe conditions. Physicians, whose duty it is to provide safe and effective medical care, are being denied the right to exercise this duty. While this denial may not be unconstitutional, it is certainly unjust and discriminatory and creates obstacles that other physicians do not face. Most importantly, these obstacles are creating an undue burden for women. The HB 2 requirements do not increase the health and safety of abortions; all they do is create substantial obstacles for women. In light of these observations, the requirements seem to me to be in clear violation of Casey, in which it was decided that, “[u]nnecessary health regulations that have the purpose or effect of presenting a substantial obstacle to a woman seeking an abortion impose an undue burden on that right.”26 These regulations do just what Casey was meant to prohibit and this is accomplished through limiting physicians’ ability to practice safe abortions across the state of Texas. Hak Joon Lee’s The Great World House: Martin Luther King Jr. and Global Ethics examines the implications of this daily global interaction as the need for a broader ethical perspective in a shrinking world. The need begins with the realization that we do indeed inhabit a shrinking world in which our local behavior has a broader global impact. Once we recognize the moral implications of our local interaction, it becomes clear that we must learn how to live together in a broader community.But how do we speak the language of a global morality? What does a global morality look like? Lee argues that King’s metaphor of a great world house provides a structure on which to frame the content of a healthy global morality in a shrinking world. The metaphor indicates a collective understanding of all humanity as a global community (ix). The notion of a single world house moves people groups beyond rival communities with well-defined in-group and out-group barriers into what Lee describes as a global civil society where we are all seen as members of a collective in-group (13). The concept of a collective in-group helps illustrate what Lee understands to be King’s argument for a global morality; “King’s idea of a great world house redefines what the boundaries and membership of a moral community are: the great world house constitutes a single inclusive ethical community for humanity because it identifies the world as a single unified community” (53). [End Page 234]But as laudable as King’s great world house metaphor is, we are still burdened with the task of imagining a universal moral language in practice. Efforts toward the formation of universal truths have historically been death-dealing for people groups caught on the wrong side of the color line. A one-size-fits-all morality has been a procrustean bed for people who have been racialized and subordinated to white European males. Yet Lee interprets King’s method of universal engagement to begin with convictions shared at home within the particularity of his African American Christian worldview before it moves outward toward a shared vision of a global civil society. The movement from particular to universal for a public morality is unlike the historically harmful practice of universal morality. King’s universal method includes attention to four components: vision, norms, virtues, and political practices. These four components belong to what Lee depicts as a careful and intricate dialectic between what is local and what is universal in a political dialogue that seeks the end of a global civil society with shared conceptions of community and human rights.Ironically, with regard to the conversation about human rights, Lee claims that King’s formative African American interpretation of human rights was primarily informed by the Enlightenment and then blended with an African American experience: “Mostly appropriated from Christianity and the Western Enlightenment tradition, these norms [justice, freedom, and equality] obtained a new significance for African Americans in the context of the sizzling cauldron of slavery and segregation” (55). Yet one would be hard pressed to identify the presence of modern Enlightenment intellectuals within the formative theological worldview of the African American Christianity that Lee identifies. Of necessity, African American Christianity, the Christian worldview that birthed Martin Luther King Jr., was formed to deflect the white Christian worldview that was shaped by the intersection of race, religion, and empire in modernity. The 2014 Varsity Medical Ethics debate convened upon the motion: “This house believes that genetic information should not be commoditised”. This annual debate between students from the Universities of Oxford and Cambridge, now in its sixth year, provided the starting point for arguments on the subject. The aim was the ‘complete’ registration of the flora, for which ‘complete’ collections in botanical institutions worldwide were considered to be a necessary basis, although this ardently sought-after ideal was never achieved. The study of colonial plants became a special priority of botanical research in the metropolises. With knowledge of the many treasures of the plant world considered the key to securing wealth and power, political and economic (...) interests influenced both the organization and the subject matter of scientific research. After the German Reich began annexing colonies in the 1880s, legal regulations established Berlin's botanical institutions as the research centre on colonial flora. They also became a clearing house for plant material from overseas. Berlin-based curators selected duplicates of herbarium specimens from the German colonies, distributing them to other botanical institutions throughout Germany. More importantly, duplicates became a form of currency in trans-imperial networks, which relied on reciprocity. In exchange for duplicate German colonial herbarium specimens, the Berlin institutions received vast quantities of botanical samples from their British, Dutch, French and American counterparts. When the International Atomic Energy Agency (IAEA) began operations in 1958, one of its first routine tasks was to create and circulate a brief non-technical periodical. This article analyses the creation of theIAEA Bulletinand its circulation during its first years. It finds that diplomatic imperatives both in IAEA leadership circles and in the networks outside them shaped the form and appearance of the bulletin. In the hands of the IAEA's Division of Public Information, the bulletin became an instrument of (...) science diplomacy, its imagery conveying the motivations for member states to strengthen ties with the IAEA, while simultaneously persuading them to accept the hierarchies and geopolitical logics implicit in those relations, as well as to endorse the central position of the IAEA as a clearing house and authority of globally circulating nuclear objects and information. The article presents the reasons for which the issue of providing housing to low-income citizens has been a real challenge in Addis Ababa during the recent years and will continue to be, given that its population is growing extremely fast. It examines the tensions between the universal aspirations and the local realities in the case of some of Ethiopia’s most ambitious mass pro-poor housing schemes, such as the “Addis Ababa Grand Housing Program” (AAGHP), which was launched in 2004 and was (...) integrated in the “Integrated Housing Development Program” (IHDP) in 2006. The article argues that the quotidian practices of communities and their socio-economic and cultural characteristics are related to the spatial attributes of co-housing practices. Drawing upon the idea that there is a mutual correspondence between social and spatial structures, it places particular emphasis on the analysis of the IHDP and aims to show that to shape strategies that take into account the social and cultural aspects of daily life of the poor citizens of Addis Ababa, it is pivotal to invite them to take part in the decision-making processes regarding their resettlement. Departing from the fact that a large percentage of the housing supply in Addis Ababa consists of informal unplanned housing, the article also compares the commoning practices in kebele houses and condominium units. The former refers to the legal informal housing units owned by the government and rented to their dwellers, whereas the latter concerns the housing blocks built in the framework of the IHDP for the resettlement of the kebele dwellers. The article analyzes these processes of resettlement, shedding light of the fact that kebele houses were located at the inner city, whereas the condominiums are located in the suburbs. Despite the fact that the living conditions in the condominium units are of a much higher quality than those in the kebele houses, their design underestimated or even neglected the role of the commoning practices. The article highlights the advantages of commoning practices in architecture and urban planning, and how the implementation of participation-oriented solutions can respond to the difficulties of providing housing. It argues that understanding the significance of the endeavors that take into account the opinions of dwellers during the phase of decision-making goes hand in hand with considering commoning practices as a source of architecture and urban planning frameworks for low-cost housing in this specific context. The key argument of the article is that urban planning and architecture solutions in Addis Ababa should be based on the principles of the so-called “negotiated planning” approach, which implies a close analysis of the interconnections between planning, infrastructure, and land. ‘Flash houses’, a distinctive type of public house associated with criminal activity, are a shadowy and little-studied aspect of early 19th-century London. This article situates flash houses within a wide perspective, arguing that the discourses on flash houses were part of concerns about the threat of the urban environment to the moral character of its inhabitants. The article draws on an original synthesis of a range of sources that refer to flash houses, including contemporary literature, newspapers, court documents, and (...) government papers. It demonstrates that flash houses were part of both popular intrigue about the perceived ‘criminal underworld’ and official concerns about the collusion between police officers and suspected offenders, since police officers allegedly frequented flash houses to gather criminal information. A detailed examination of this term reveals anxieties about the state of the metropolis, poverty, and criminality that were central to the early 19th-century consciousness. However, the discussion of flash houses in this context also demonstrates a powerful connection in contemporary minds between the physical spaces of the city and the risks that they posed to inhabitants' morals. While associations between the physical environment and morality have been drawn throughout history, flash houses represent a paradigmatic moment in this dialogue. This is because different moral concerns coalesced around the discourse on flash houses: anxieties about the criminal underworld, the potential for moral degradation of young people who frequented these spaces, and the corruption of police officers through contact with known or suspected offenders. The houses are made of car windshields, (...) surplus carpet tiles, baled cardboard, old street signs, license plates, etc. Alexis de Tocqueville has said that democracy lowers the standards of creation,1 and it seems that, for architecture, this has become a sad truth in many cases in industrialized countries. The Rural Studio wants to contradict this tendency by showing that even within the context of civic engagement, elements like style and art are not bound to disappear. "Participatory design" as well as "community design" are common in the United States in the public as well as in the private sector.2 The Rural Studio's aim to offer decent architecture in terms of material quality as well as remain consistent when it comes to aesthetics sticks out of the landscape not only of community design but even the history of modern Western architecture. There is nothing new in reducing rich people's lives to functionalism, but the ambition to enhance poor people's lives through art can still be considered as rather eccentric.Kitsch Culture and Junk CultureNegotiating style when being engaged in compassionate projects is certainly a difficult task. Everybody needs food, clothing, and shelter, but who needs [End Page 16] art? The worst outcome that such negotiations can have is, of course, the victory of social pragmatism over art, simply declaring that "they don't need that." However, this is not the only miscarriage to be expected. Another likely disaster is that the suggested artistic activity will be refused by the clients at the onset. Community design architects confirm that "when it comes to houses people are much more conservative."3 The aesthetic standards of the lower middle class especially are often determined by numerous prejudices about "what a house should look like."The aesthetic standards of the status-seeking middle class, however, are generally more open, as their visions of an ideal house are often determined by a moderately adventurous hedonism striving to conquer new aesthetic models and experiences. The problem is that, sometimes, their projects will run directly into the aesthetic dead end of kitsch, or camp, because their openness is often superficial; instead of being determined by a kind of postmodern self-criticism, it remains rather dependent on thoughtless consumer attitudes. The desire to display and impress at any cost—a strain already put forward by Tocqueville—corrupts the taste of many American middle-class members and makes truly artistic architectural expressions oftentimes impossible. In the worst case, this attitude will be conducive to the desire to "acquire beautiful junk," which is, according to the aesthetician Matei Calinescu, the classical mechanism leading to the creation of kitsch culture.4 The original German definition of "kitsch" is that "which makes use of refuse taken bodily from the rubbish dump."5The architects of the Rural Studio use predominantly junk, which forces us to consider the question: How do they manage to escape the aesthetics of kitsch? From a historical perspective, kitsch culture is the product of the European middle classes (though it has also constantly been imitated by lower-income classes). This article deals with property laws, based on two premises. Firstly, property law as means to a contemporary comprehension of social and crime control. Secondly, it posits that the focus has shifted from law and society to law in society. It is concerned with the ways in which law and legality are interpreted and invoked in social life and focuses specifically on their role in the commonplace construction of home, tenure, exclusion, and jurisdiction. It analyses the relationship between the meanings (...) of home and the relationship of home with housing tenure. It identifies defense and exclusion as particular aspects of the property relation, and draws on research into gated communities as a particular example of that relation. This article then proceeds to link this notion of exclusion with broader studies into mapping and jurisdiction. It emphasizes the formal and informal mechanisms through which the notions of home and tenure are thought. It draws on the law–geography interface as an example of research, which has the potential to extend the boundaries of our appreciation of property in law. (shrink)

For more than seven decades there has been a broad gap between how philosophy is conceived and practiced. Two ill-defined but well-recognized traditions have developed—the "analytic" and "Continental" schools of philosophy. The former traces its roots to philosophers like Frege, Russell, Moore, Wittgenstein, and the logical positivists. The latter has been heavily influenced by Nietzsche, Heidegger, Merleau-Ponty, Foucault, and Derrida, among others. The aim of this collection is to reconsider the often facile characterization of major thinkers as belonging to either (...) one or the other philosophical tradition. The contributors—philosophers from both sides of the divide working in different countries and contexts—all question the problematic conception that the two traditions are incommensurable. Each of their articles compares individual philosophers who have had a major influence on the analytic and Continental traditions with a view to clarifying their similarities and dissimilarities of approach. Quantum Information Theory and the Foundations of Quantum Mechanics is a conceptual analysis of one of the most prominent and exciting new areas of physics, providing the first full-length philosophical treatment of quantum information theory and the questions it raises for our understanding of the quantum world. -/- Beginning from a careful, revisionary, analysis of the concepts of information in the everyday and classical information-theory settings, Christopher G. Timpson argues for an ontologically deflationary account of the (...) nature of quantum information. Against what many have supposed, quantum information can be clearly defined (it is not a primitive or vague notion) but it is not part of the material contents of the world. The interesting thing about the word for ‘palace’ in Homer is that there is no such word. All the words that mean ‘house’ may be applied to a royal palace, but all of them may equally well be used of the house of an ordinary citizen, μέγαρον is often translated ‘palace’, or some other word with connotations of kingly majesty. But it too, when it is not more narrowly localised to the living-room, means just a house in (...) general.Just as there is no separate word to designate a palace in Homer, so a qualifying adjective is never used to indicate that a particular house is ‘royal’. In fact, to Homer there is no sharp distinction between a palace and a house, except that a king is likely to have a bigger and better home, more sumptuously furnished.The Iliad and the Odyssey are much concerned with kings. So it is odd that no word serves to designate the king's palace and no other dwelling, especially when the poet so delights in describing the splendour of royal homes. The major archaeological sites of the Mycenaean period, in which the main stories of the poems are set, all contain a palace which is easily recognised, even in its ruinous state. Can one imagine a new arrival at a great Mycenaean site needing to be shown which was the palace, as Odysseus was shown at Phaeacia? It seems highly unlikely that the Mycenaeans should have had no special word for a palace, though there is so far no firm evidence for the existence of such a word in Linear B. If a ‘palace’ word existed, its special significance, if not the word itself, must have been forgotten by Homer's time, when a great many houses might be found within the city wall, as at Smyrna. There may, however, be traces of the ‘palace’ meaning still detectable.In Table 1, which has been compiled from the concordances of Prendergast and Dunbar, I have tabulated the frequency with which each of the regular words for ‘house’ is used to denote a dwelling occupied by gods, lesser divinities, mortals or animals. Various interesting points arise from this table.It is apparent that there is a far higher proportion of gods' houses mentioned in the Iliad than in the Odyssey. The figures for δόμος and δῶμα show this particularly clearly. Jane Addams's early attempt to empower the people with information.

Near the beginning of In Toga Candida, Cicero informed his audience of a private meeting between his two most serious competitors for the consulate and the managers of their campaigning funds. This meeting took place at the house of a nobleman whom Cicero did not name but to whom he attributed a signal notoriety in the practice of electoral corruption. Asconius offers a solution without hesitation: it was at the house of either Caesar or Crassus. He explains his (...) choice: these two men were Cicero's most committed and influential opponents in his campaign for the consulate, and he has excellent evidence for their opposition: Cicero's own Expositio consiliorum suorum, no longer extant. The credibility or otherwise of this controversial work must be dismissed from any enquiry into the identity of the mysterious figure, however. Asconius, in naming the two alternative possibilities, discloses himself to be without authoritative evidence on the point. Nothing can have been said in De consiliis suis to identify the house, the meeting, or the notorious nobleman. Asconius' words reveal that his attempt at an identification is based on Cicero's assertion therein of an overt hostility to him on the part of both Crassus and Caesar during the campaign. His attribution of a covert ‘dirty tricks’ operation to one of them is no more than speculation. (shrink)

This article describes the daunting challenge of precarious housing in Salvokop located in the southern part of inner City of Tshwane, Gauteng Province. Insecure tenure, unmaintained dwellings, overcrowding, mushrooming of backyard shacks and the rise of the informal settlement, all that led to deep levels of vulnerability and neighbourhood deterioration. Current conditions show that life in that neighbourhood is fraught as substandard housing degenerated into slum and squalor. This concern emerged among other salient pressing issues of poverty and vulnerability from (...) the World Café and Focus Groups with the inner city churches including those from Salvokop. The article set out to describe precarious housing, unpleasant living conditions owing to the fact that human beings stay in unsuitable dwellings while the environment deteriorates. Taking into account their circumstances, the article’s aim was to recapture the extent to which the residents suffer as a result of living in dwellings unfit for human habitation, rethinking an alternative model to respond. A theological agenda for future ecclesiological engagement was discerned forthwith recommendations. The article makes a contribution towards the theology of the city in that it stimulates church practices and housing of poor people in Tshwane. It does so by engaging in a unique way grassroots knowledge from the different inner city congregations. This process used the platform of surveys, World Café style gatherings and Focus Groups. In conversation with the primary source, this article also contributed with original data generated with the Salvokop residents whose stories helped to expend on horizons of housing, which is acknowledged. All the inner city church contributors of the realisation of the study objectives are also recognised. (shrink)

This short personal essay considers the principles behind housing reform in New York at the turn of the last century in light of the controversies around the ghetto law in contemporary Denmark. I take the example of documentary journalist and reformer Jacob Riis, who photographed housing conditions in immigrant neighbor-hoods on the Lower East Side in New York at the turn of the twentieth century, as a case study for considering the ways that race informed—and continues to inform—ideals around urban (...) planning. Conversely, I also consider contemporary controversies around the ghetto law, and activism by community members as a way of re-thinking a research approach to historical urban reforms. (shrink)

The idea is that, in a wide range of contexts, utterances of the sentences in (a) in each case will communicate the assumption in (b) in each case (or something closely akin to it, there being a certain amount of contextually governed variation in the speaker's propositional attitude and so the scope of the negation). These scalar inferences are taken to be one kind of (generalized) conversational implicature. As is the case with pragmatic inference quite generally, these inferences are defeasible (...) (cancellable), which distinguishes them from entailments, and they are nondetachable, which distinguishes them from conventional implicatures. The core idea is that the choice of a weaker element from a scale of elements ordered in terms of semantic strength (that is, numbers of entailments) tends to implicate that, as far as the speaker knows, none of the stronger elements in the scale holds in this instance. The pattern is quite clear in (1) and (2), where the weak/strong alternatives are some/all and five/six respectively. In the case of (3), the stronger expression must be intelligent and good-hearted which entails intelligent; what Y's utterance implicates is that Mary does not have the two properties: intelligence and good-heartedness, so that, given the proposition expressed (Mary is intelligent) it follows, deductively, that she is not good-hearted, in Y's opinion. The example in (4) involves a scale inversion due to the negation, so that the weak/strong alternatives are not necessarily/not possibly; the negation which the scalar inference generates creates a double negation, which is eliminated giving possibly. Background Informed consent prior to nursing care procedures is an established principle which acknowledges the right of the patient to authorise what is done to him or her; consent prior to nursing care should not be assumed. Nursing care procedures have the potential to be unwanted by the patient and hence require an appropriate form of authorisation that takes into consideration the relationship between the nurse and patient and the ongoing nature of care delivery. Research question How do nurses obtain (...) consent from patients prior to nursing care?. Design Critical incident technique and the collection of critical happenings. Participants 17 participants who were all qualified nurses took part in in-depth interviews Ethical considerations Ethical approval was obtained from the university ethics committee. Findings Information giving is a key component prior to nursing care procedures. Nurses provide information to patients as a routine aspect of care delivery, and do so even when the patient is unable to communicate themselves. Whilst some participants described how information giving might be rushed or overlooked at times, it is clearly an established part of nursing care and is provided to ensure the patient knows what to expect when care is delivered. What is less clear is the extent to which information is given in order to seek the consent – rather than merely inform the patient – about nursing care. Conclusion Implied consent is often an appropriate way in which consent is obtained prior to nursing care procedures. It takes into account the ongoing care provision and the relationship that exists between the nurse and patient. However implied consent should not be assumed. Nurses need to ensure that information is given not only to inform the patient about a procedure but to enable the patient to give his or her consent and to find an alternative way forward if the patient withholds their consent. Tononi has proposed a fundamental theory of consciousness he terms Integrated Information Theory (IIT). IIT purports to explain the quantity of conscious experience by linking it with integrated information: information shared by the system as a whole and quantified by adopting a modified version of Shannon's definition of information. Since the fundamental aspect of IIT is information the theory allows for the multiple realizability of consciousness. While there are several concepts within IIT that need further (...) theoretical development, the main failings of the theory are an absence of a link between conscious experience and awareness and the use of Shannon's limited data based definition of information. These limitations prevent the theory from satisfying Chalmers' principles of structural coherence and organizational invariance which any functionalist theory should obey. It is not clear whether IIT can be repaired without simply reducing the theory to a general statement of computational functionalism. (shrink)

OBJECTIVE: To examine the long-term effects of an innovative curriculum on medical house officers' (HOs') knowledge, confidence, and attitudes regarding medical ethics. DESIGN: Long term cohort study. The two-year curriculum, implemented by a single physician ethicist with assistance from other faculty, was fully integrated into the programme. It consisted of monthly sessions: ethics morning report alternating with didactic conferences. The content included topics such as ethics vocabulary and principles, withdrawing life support, informed consent, and justice. Identical content was offered (...) simultaneously at the largest affiliated community hospital. SETTING: A multi-hospital university training programme from July, 1992 to June, 1994. PARTICIPANTS: Thirty-nine HOs responded in 92. Thirty HOs from the same cohort responded in 94 (response rates = 83% v 71%; P = 0.19). RESULTS: The curriculum was well received, with 96% of HOs finding the sessions stimulating. Previously validated scales of knowledge and confidence were administered at baseline and at follow-up. The average knowledge score improved 14% (P < 0.001). Confidence also improved, rising from 3.3 to 3.8 on a 5-point Likert scale (P < 0.001). These findings were independent of age, gender, religion, and prior education. The only attitudinal change was an increase in the proportion of residents who thought that ethics should be a required part of residency training (57% v 80%, P = 0.05). CONCLUSION: This curriculum appears practical, popular, and effective. It should be readily transferable to other institutions. (shrink)

The article addresses the problem of how semantic information can be upgraded to knowledge. The introductory section explains the technical terminology and the relevant background. Section 2 argues that, for semantic information to be upgraded to knowledge, it is necessary and sufficient to be embedded in a network of questions and answers that correctly accounts for it. Section 3 shows that an information flow network of type A fulfils such a requirement, by warranting that the erotetic deficit, (...) characterising the target semantic information t by default, is correctly satisfied by the information flow of correct answers provided by an informational source s. Section 4 illustrates some of the major advantages of such a Network Theory of Account (NTA) and clears the ground of a few potential difficulties. Section 5 clarifies why NTA and an informational analysis of knowledge, according to which knowledge is accounted semantic information, is not subject to Gettier-type counterexamples. The theories of information ethics articulated by Luciano Floridi and his collaborators have clear implications for law. Information law, including the law of privacy and of intellectual property, is especially likely to benefit from a coherent and comprehensive theory of information ethics. This article illustrates how information ethics might apply to legal doctrine, by examining legal questions related to the ownership and control of the personal data representations, including photographs, game avatars, and consumer profiles, that have (...) become ubiquitous with the proliferation of information and communication technologies. Recent controversy over the control of player performance statistics in “fantasy” sports leagues provides a limiting case for the analysis. Such data representations will in many instances constitute the kind of personal data that information ethics asserts constitutes an information entity. Legal doctrine in some instances proves sympathetic to such an assertion, but remains largely inchoate as to which data might constitute a given information entity in a given instance. Neither is information ethics, in its current state of development, entirely helpful in answering this critical question. While information ethics holds some promise to bring coherence to this area of the law, further work articulating a richer theory of information ethics will be necessary before it can do so. Informed consent is an essential step in helping patients be aware of consequences of their treatment decisions. With surgery, it is vitally important for patients to understand the risks and benefits of the procedure and decide accordingly. We explored whether a written IC form was provided to patients; whether they read and signed it; whether they communicated orally with the physician; whether these communications influenced patient decisions. Adult postsurgical patients in nine general hospitals of Italy’s Campania Region were interviewed via (...) a structured questionnaire between the second and seventh day after the surgery at the end of the first surgical follow up visit. Physicians who were independent from the surgical team administered the questionnaire. The written IC form was given to 84.5% of those interviewed. All recipients of the form signed it, either personally or through a delegate; however, 13.9% did not know/remember having done so; 51.8% said that they read it thoroughly. Of those who reported to have read it, 90.9% judged it to be clear. Of those receiving the written consent form, 52.0% had gotten it the day before the surgery at the earliest 41.1% received it some hours or immediately before the procedure. The written IC form was explained to 65.6% of the patients, and 93.9% of them received further oral information that deemed understandable. Most attention was given to the diagnosis and the type of surgical procedure, which was communicated respectively to 92.8 and 88.2% of the patients. Almost one in two patients believed that the information provided some emotional relief, while 23.2% experienced increased anxiety. Younger patients and patients with higher levels of education were more likely to read the written IC form. The written IC form is not sufficient in assuring patients and making them fully aware of choices they made for their health; pre-operative information that was delivered orally better served the patients’ needs. To improve the quality of communication we suggest enhancing physicians’ communication skills and for them to use structured conversation to ensure that individuals are completely informed before undergoing their procedures. An influential idea in the epistemology of testimony is that people often acquire justified beliefs through testimony, in contexts too informationally poor for the justification to be evidential. This has been described as the Scarcity of Information Objection (SIO). It is an objection to the reductive thesis that the acceptance of testimony is justified by evidence of general kinds not unique to testimony. SIO hinges on examples intended to show clearly that testimonial justification arises in low-information contexts; I (...) argue that the common examples show no such thing. There is a great deal of information available in testimonial contexts, including in the examples alleged to show otherwise – enough information to render SIO implausible. Purported SIO examples tend to give a wrong impression about the informational richness of testimonial contexts, I argue, due to the lack of detail in which they are presented. (shrink)

Information and communication technology has become the great technological fix of our time and not the least in the education system. There seems to be no end to the hype of ICT and the accompanying promises that education will be revolutionized—“smart” pupils will be made and the so-called knowledge society propelled. This master narrative has many co-authors, some of whom have the best intentions and realize the big challenge of educating the world population. Information is the fourth core element of public health legal preparedness and of legal preparedness for public health emergencies specifically. Clearly, the creation, transmittal, and application of information are vital to all public health endeavors. The critical significance of information grows exponentially as the complexity and scale of public threats increase.Only a small body of organized information on public health law existed before the 21st century: a series of landmark books published beginning in 1926 by Tobey, (...) Grad, and Wing ; model public health laws published as early as 1907; systematic reviews of original research studies published in the 1990s; and a small but growing number of articles published in public health journals and law reviews.With the new century came new public health law programs and activities at the Centers for Disease Control and Prevention, in public health professional associations, and in numerous non-profit and academic organizations. Abstract:The increasing needs for housing in Ghana is a result of urbanisation which is also a sign of improvement in the socio-economic lives of the people. Building of houses usually replaces prime vegetation land. The rate of indiscriminate devegetation for housing purpose in Ghana is as a result of the lack of a comprehensive land use policy implementation in the country. It is clearly stated in the country's land use policy that ‘the principle of optimum usage for all types of (...) land uses will be assured by the state and that, the state will ensure every socioeconomic activity is consistent with sound land use through sustainable land use planning in the long-term. But, evidence in the country is contrary to what is stipulated in the land use policy document. The study therefore, contributes to the environment-spatial land use conflict debate. It does this by focusing on the fast rate at which agricultural land at the fringes of urban Ghana is mainly used for housing purposes. It uses Accra and Tamale as examples to argue that if the content of the land use policy is not implemented to minimise the excessive devegetation for housing, the country stands the chance of losing utterly, its natural vegetation, especially, the forest vegetation. With the help of old maps, GIS and researchers’ observations, the study describes how the land use cover in areas close to the cities of Accra and Tamale has largely been replaced by housing. It ends by advocating sound sustainable housing typologies which will reduce the rate of devegetation in the country. (shrink)

Although the everyday notion of information has clear semantic properties, the all-pervasive technical concept of Shannon information is usually considered as a non-semantic concept. In this paper I show how this concept was implicitly ‘semantized’ in the early 1950s by many authors, such as Rothstein or Brillouin, in order to explain the knowledge dynamics underlying certain scientific practices such as measurement. On the other hand, I argue that the main attempts in the literature to develop a quantitative measure (...) of semantic information to clarify science and scientific measurements, such as Carnap-Bar-Hillel, or Dretske, will not successfully achieve this philosophical aim for several reasons. Finally, I defend the use of a qualitative notion of semantic information within the information-theoretical framework MacKay to assess the informational dynamics underlying scientific practices, particularly measurements in statistical mechanics. The omnipresence of information and its role of the central/basic element within different contexts represents one of the main characteristics of our contemporaneity. In everydayness of inauthentic Da-sein the amount of pure information obscures deeper questions; nevertheless, the understanding of its role is crucial for the contemporary approach towards interpreting phenomena in our environment. Transfer of the concept of information is therefore crucial for the contemporary description of physical reality, evolution and for contemporary construction of the subjective (...) time and its link with the objective one, while its multiple connections with contemporary space-time can be most directly seen in literature. Reflection of these transfers by combining and rethinking their findings consequently emphasizes the vanishing border between different fields and makes complex, clear and contemporary review of the question and the partly constructed answer of us and our environment possible.
